Terms of service

These terms were written for a software service between businesses. They have not been reviewed by a lawyer. Have them checked legally before you work with real paying customers, and again before selling into markets outside the EU.

1. Who we are

Referred to below as "EasyGym", "we" or "us". By "you" we mean the personal trainer, coach or business taking out a subscription.

2. What the service is

EasyGym is web-based software that generates a training block per client based on goal, level, injuries and available equipment, and exports it as a PDF. The dosage rules are based on generally accepted exercise science guidelines (among them ACSM and NSCA).

EasyGym is a tool for qualified professionals, not a medical device. The software makes no diagnosis and does not replace medical advice. As the trainer you remain responsible for reviewing, adapting and supervising every plan, and for referring a client to a physician or physiotherapist when that is appropriate.

3. Subscription, term and renewal

A subscription runs per month and starts the moment your payment is confirmed. It is automatically renewed for another month each time until you cancel. There is no minimum term and no annual contract.

4. Prices and payment

The applicable prices are on the pricing page. Prices are charged in euro. Payment is made in advance per month through our payment provider Stripe. We do not store card details ourselves.

If a payment fails, we retry it. If it keeps failing, we may suspend access to your account until payment is made. Your data is retained during that period; it is not erased immediately.

5. Price changes

We may adjust our prices. We announce a price change at least 30 days in advance by email. If you do not agree, you can cancel before the effective date; the old price then applies until the end of your current month.

6. Cancellation

You can cancel at any time. Cancellation takes effect at the end of the current billing period: you keep access until that date and nothing is charged afterwards. Months already paid for are not refunded.

We may terminate the agreement with 30 days' notice, or immediately in the event of abuse, non-payment or unlawful use of the service.

7. Plans and client limits

Every plan has a maximum number of active clients. That limit is enforced technically: at the maximum you cannot add a new client until you upgrade or archive an existing one. You lose nothing in the process: existing clients and plans keep working.

Upgrading is possible at any time and takes effect immediately. Downgrading takes effect at the next billing period. If your account then holds more clients than the lower plan allows, they stay visible but you can only add new clients once you are back under the limit.

8. Availability of the service

We make reasonable efforts to keep EasyGym available and working, but we give no guarantee of uninterrupted availability and promise no specific uptime percentage. Maintenance, updates and outages at external suppliers (hosting, database, payment provider) can cause temporary interruptions. We announce planned maintenance with impact in advance where possible.

9. Your data stays yours

The client data and workout plans you enter or generate in EasyGym remain yours. We use them solely to deliver the service. We do not sell them, do not share them with third parties for their own purposes, and do not use them for advertising.

For as long as your account is active you can export your plans as PDF at any time. After cancellation we keep your data available for 30 days so you can export everything. After that we delete it. If you want deletion sooner, request it at info@geteasygym.com and we will carry it out.

10. Intellectual property

The software, the exercise database, the rule engine, the texts and the EasyGym brand remain our property. You receive a non-exclusive, non-transferable right of use for as long as your subscription runs.

You are free to use the plans you generate in your own practice and to give them to your clients. What is not allowed: copying or reselling the software or the exercise database, building a competing service with it, or extracting data from the service in an automated way.

11. Liability

EasyGym supplies software, not training or medical advice. As a professional, you judge whether a plan is suitable for a given client. We are not liable for injury or damage arising from the execution of training.

Our liability is limited to direct damage and to a maximum of the amount you paid us in the twelve months before the damaging event. We are not liable for indirect damage, such as lost profit, loss of clients or reputational harm.

These limitations do not apply in the case of intent or gross negligence on our part, nor in cases where the law imposes liability mandatorily.

12. Changes to these terms

We may adjust these terms. We announce substantive changes at least 30 days in advance by email. If you keep using the service after that, the new terms apply. If you do not agree, you can cancel before they take effect.

13. Governing law and competent court

This agreement is governed by Belgian law, regardless of where you are established. We first try to settle disputes by mutual agreement. If that fails, the courts of the judicial district where EasyGym is established have jurisdiction. Mandatory provisions of the law of your own country that cannot be contracted away remain unaffected.
